STEPS
TO RECOVER RESTITUTION
The
Worthless Check Unit of the Jefferson County District
Attorneys Office opened for business in the the fall
of 1992. Since that time more than $9,000,000.00 in
restitution has been collected and returned to victims.
The
following steps will assist you in collecting your
bad check losses and further explain your role in
the process of collecting restitution. Please note
that in order to utilize the services of the Worthless
Check Unit the check must have been presented to
the bank within 30 days of receipt.
STEP
5: MERCHANT RESTITUTION On the date of the agreement, the defendant will be expected to
pay to our office, the face amount of the Worthless
Check plus a statutory merchant service charge
and a District Attorney Service Fee.
Restitution will be paid to the merchant once a month by our office. Due
to the volume of cases, any inquiry about pending cases must be made
in writing. We will respond in writing within (10) working days.

STEP
6: DEFENDANT ARREST A Defendant will be arrested
by a Disrict Attorney's Ingestigator if he/she fails
to respond to our office, or is he/she fails to comply
with the restitution agreement.
IF THE CASE GOES TO COURT:
- The
person (Merchant or designee) who signed the Warrant
will be required to appear in court and give testimony.
- The
person who accepted the check, and can identify
the defendant will be required to appear in court
and give testimony.
- An
Assistant District Attorney will be assigned to
prosecute the bad check writer.
- A
misdemeanor file will be set up in our office for
use by the Assistant District Attorney.
- The
disposition of the case will be recorded in our
files.
OUR
UNIT WILL:
- Assist the District Attorney with the relevant information, including
prior record and prior appearances in the Worthless
Check Unit.
- Assist the Merchant through the trial process.
